By using this website, you are agreeing to all of these terms and conditions, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms and Conditions.
Access to this website is permitted on a temporary basis, and we reserve the right to withdraw or amend the services of this website without notice. We will not be liable if for any reason this website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this website.

Ordering
Orders can be made at any time on the website. You can also contact Contempa by calling New Zealand +64 9 476 8650 (698 7363) or Australia free phone 1800 268 115 between 9am to 5pm NZST.
Alternatively, email the Contempa team. Please do not include your credit card information in any email. A member of the Contempa team will contact you during our regular business hours of Monday to Friday, 9am to 5pm to process your order.
Orders begin processing upon approval and verification of credit card or DPS information. Certain orders may require special processing because of limited quantities. You will receive email updates with regards to any "out of stock" delays. If any "out of stock" delays are unsatisfactory, you can cancel your order and request a refund of your purchase.
The website, the information on it and any information in emails constitute an invitation to treat and not an offer to supply products. When the customer orders products from Contempa, this constitutes an offer from the customer to buy those products in accordance with these terms and conditions. Contempa’s acceptance of the customer’s order occurs (and the contract is formed) when the items are dispatched to the customer.
Order Process
The customer may order products by completing and submitting the checkout process on the Contempa website. The customer must provide all required information (including name, email address, and payment details) or Contempa may not be able to process the order.
Discretion in Rejecting Orders
No order shall be deemed accepted by Contempa until Contempa has sent the customer a copy of the order. Contempa reserves the exclusive right to accept or reject (for any reason whatsoever and in whole or in part) any order submitted by the customer. If Contempa rejects the customer's order (or part of the order), any money paid by the customer in relation to the rejected part of that order shall be refunded and Contempa shall have no further liability to the customer in relation to the rejected part of that order.
Availability & Cancellation
All orders are subject to the availability of products. If for any reason a product is not available, Contempa will endeavour to notify the non-availability on the website. Contempa may revise the range of products or the specification of any product at any time and without notice to the customer.
Cancellation of Orders
Where products are listed on the website with an incorrect price or with incorrect information, Contempa reserves the right to cancel the customer's order (regardless of whether the customer has made payment for that order). Where the customer has already made payment for an order that is subsequently cancelled by Contempa, Contempa will refund the amount paid by the customer in relation to that order.
Contempa may cancel the customer's order any time prior to order confirmation. Any variation, waiver or cancellation of the customer's order shall have no effect unless accepted in writing by Contempa. Where the Contempa accepts cancellation, Contempa may levy a handling charge of up to 15% of the price.
Promotions
Site-wide promotions are offered on a limited time basis and are not honored past the expiration date. Site-wide promotions may not be applied to already discounted or bundled products that are already priced below regular retail price of the individual products collectively. These products are noted throughout the website.
Discount Vouchers
In order to redeem a Discount Voucher, you must have an account with Contempa and be logged in. Enter your promo code on the shopping cart page after adding items to your cart.
You cannot use a Discount Voucher in conjunction with any other sales discounts or promotional offers unless the specific terms relating to the Promotional Discount Codes state that you can combine the Promotional Discount code with other offers.
The Discount Voucher will expire on the date specified in the specific terms relating to the Discount Voucher, or before subject to availability of which we will notify you via the website. You cannot use the Promotional Discount Voucher after this date. Discount Vouchers have no cash redemption value.
We reserve the right to vary or discontinue the Discount Voucher scheme at any time. We have the right to revise and amend these terms and conditions of sale from time to time including to reflect changes affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our site's capabilities.
You will be subject to the policies and terms and conditions of sale in force at the time that you use your Discount Voucher, unless any change to those policies or these terms is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).

Terms of Sale
By placing an order you are offering to purchase an item on and subject to the these terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery & Shipping for further information.
In order to contract with Contempa you must possess a valid credit or debit card issued by a bank acceptable to us. Contempa retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the items. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
Our Contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the items will not be formed until your payment has been approved by us and we have debited your credit or debit card.
Pricing & Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any items which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the items, you will receive a full refund. Where applicable, prices are inclusive of GST and VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Grand Total’.
Payment
Contempa accepts the following credit cards: Visa and Mastercard
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Orders begin processing upon approval and verification of credit card information. Items will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
In any cases where items are "Out of Stock” or discontinued, we will contact you and issue a full refund.

Consumers Guarantees Act 1993
Where the customer is not a consumer as defined in Section 2 of the Consumer Guarantees Act 1993, the Act shall not apply to the supply of product or services. The liability of Contempa whether in contract or in tort for any loss, damage or injury arising directly or indirectly from any defect or non-compliance of the items supplied is limited to replacement or repair of such items or damages not exceeding the invoice value of such defective or non-complying items at the option of Contempa. Contempa shall not be liable for any consequential indirect or special damage or loss of any kind whatsoever. The description of items in the order is given as an aid in identification of the items and it is not a condition of supply that the items shall correspond precisely with the description given or that colours shall match samples exactly.
Errors or Omissions
Contempa is entitled at any time to correct all errors and omissions (whether clerical, computational or otherwise) in any advertising, quotation, invoice or acknowledgement. In the event that a Contempa product is mistakenly listed at an incorrect price, Contempa reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Due to the Contempa’s administrative processes, errors (if any) may be discovered up to 30 days after the items have been delivered to the customer. Contempa will notify the customer promptly of any error or omission discovered by Contempa. If your credit card has already been charged for the purchase and your order is cancelled, Contempa shall refund your credit card account the amount of the incorrect price. If the items have been delivered, Contempa will give the customer the option of returning the items for refund.
Ownership & Risk
Ownership of all items sold by Contempa is retained by Contempa until Contempa has received the full price for the items and the applicable delivery charges. This provision is designed to protect Contempa in the event of the bankruptcy, receivership or liquidation of the customer, a seizure of items by a creditor of the customer or default in payment.
